In brief:
Indyish is not responsible for the words, actions or opinions of Indyish artists. Indyish artists aren’t responsible for how we behave either.
Indyish artists are solely responsible for their sales, their customer relations, the timeliness of their shipping and the quality of their product. Indyish may try to help out with these things, but that’s it. No liability.
In detail:
1. Artists are responsible for shipping quality work promptly and accurately. Indyish is in no way responsible for the behavior of artists or customers. We try to provide a system for artists that supports best practices and helps them conduct their business in a safe and technologically competitive manner, but in all cases it is the artist who bears the weight of being their own small business. That being said, it is in our interest to ensure that everyone who interacts with Indyish has a positive experience.
2. Artists are responsible for letting their customers know when they or their products are unavailable. We’ve made this easy, we think (if not, let us know), with the quick options we’ve added to the back end.
3. Artist groups are responsible for picking one person to be their contact with Indyish. The contact is responsible for maintaining a valid and up-to-date primary email address and phone number with indyish.com. Indyish will not be held responsible for problems arising from the contact’s failure to do so. (Try to make sure you have the right person as contact. If your contact gets too busy to manage it, switch it up.)
4. Artists must publish content for which they own the copyright. Of course, they are also entitled to publish content which they have critically altered in keeping with the Canadian Copyright provision on Fair Use. Note: There is also a world of creative work that you can legally draw from and use with varying degrees of freedom, licensed under open source licenses like those gathered under the umbrella of the Creative Commons.
5. Artists may not use indyish.com to sell or promote illegal material. In no case will Indyish be responsible for members who break this term. Any member who is found to have violated this clause will have their content removed without prior notice and their account suspended.
6. Artists are responsible for keeping their records up to date. Artists should keep their email interactions, accurate photographs of each item they make, as well as shipping receipts to protect themselves in the event of a charge-back or other form of refund.
7. The amount that is available for pre-order should be determined by the amount that an artist could make within the next 30 days. If an artist receives a large order, it is the group contact’s responsibility to make sure that the amount available for pre-order is still viable.
8. All items bought on indyish.com are refundable within 30 days from the initial date of purchase. Neither Indyish nor the Artist is responsible for complaints submitted after this time. Similarly, customer complaints or requests for exchange must be made within 30 days of the original shipping date.
9. If, once a customer receives a product, they find it doesn’t fit, and if the garment or product is unworn, un-scuffed and entirely undamaged, then it can be returned to the Artist to be exchanged for another size, or for artist-specific credit. Credit, if issued, is good for one year. If an innacurate size was shipped, then the Artist should pay shipping. In all other cases, the Customer will incur the cost of returning items.
10. Shipping: the cost of shipping is added at the point of purchase and is absorbed by the customer. In the event of an exchange both sides (artist and customer) are responsible for their own shipping.
11. Artists are under no obligation to sell their work exclusively on indyish.com. You can sell elsewhere, promote your own work elsewhere, have your own site, compete with this site. In fact, all that stuff’s a good idea.
